رشته "حقوق مهاجرت" که شاخه ای نورسته از درخت نه چندال کهنسال حقوق بین الملل است؛ در کشور ایران ناشناخته تر از سایر کشورها باقی مانده است و شاید نیاز باشد با عنایت به مبتلا به بودن؛ کشورمان به مسأله مهاجرپذیری و مهاجرخیزی به این شاخه از حقوق با تأمل بیشتری نگریسته شود.

Established in 1951, the International Organization for Migration (IOM) is the principal intergovernmental organization in the field of migration. We are growing rapidly and currently count 125 member states. A further 16 states hold observer status, as do numerous international and non-governmental organizations. IOM’s programme budget for 2007 exceeds US$ 783.8 million, funding over 1,770 active programmes and more than 5,600 staff members serving in over 420 field offices in more than a hundred countries.

IOM is dedicated to promoting humane and orderly migration for the benefit of all. It does so by providing services and advice to governments and migrants. IOM works to help ensure the orderly and humane management of migration, to promote international cooperation on migration issues, to assist in the search for practical solutions to migration problems and to provide humanitarian assistance to migrants in need, be they refugees, displaced persons or other uprooted people. The IOM Constitution gives explicit recognition to the link between migration and economic, social and cultural development, as well as to the right of freedom of movement of persons. IOM works in the four broad areas of migration management: migration and development, facilitating migration, regulating migration, and addressing forced migration. Cross-cutting activities include the promotion of international migration law, policy debate and guidance, protection of migrants’ rights, migration health and the gender dimension of migration. IOM works closely with governmental, intergovernmental and non-governmental partners.

The relationship between countries of origin and their overseas communities is key to successful development. IOM’s goal in this field is to harness the development potential of migration for individual migrants and societies. We work by promoting international policy dialogue, policy-oriented research and programmes that strengthen the administrative and managerial capacity of governments. Programme activities include improving remittance management, building human capital through labour migration programmes, return and reintegration of qualified nationals, capacity building for governments and empowerment of migrant women.

Mobility is an essential feature of today’s world. Integrated world markets, the emergence of transnational networks and the rapid growth of communication technologies all contribute to the increasing movement of both high and low-skilled workers, students, trainees, families and tourists. The demographic and social structure in the industrialized world has created the need for workers and professionals from other countries Large-scale migration for work represents potentially difficult adjustments, but economies that desire to remain competitive cannot ignore the need for change. Facilitating migration for work can be a win-win proposition. IOM provides policy and technical advice to governments on the regulation of migrant labor and other migratory movements, and carries out programmers to assist governments and migrants with selection/recruitment, language and cultural orientation, consular services, training, reception, integration and return. These services, tailored to each programme,are provided during all stages of the process:

information and application, interview and approval, and post-approval. IOM has performed over 1.5 million immigration medical evaluations around the world and provides logistic and travel assistance to migrants. on Governments and societies have an interest in knowing who is seeking access to their territories. The objective is to take measures that prevent access by those who are not authorized to enter, while facilitating speedy access for those who are. IOM assists governments in the development and implementation of migration policy, legislation and administrative mechanisms. To this end, IOM provides technical assistance and training for governmental migration managers on border management, visa systems, regulating entry and stay and collecting and using biometric information. Replacing irregular flows with orderly, regular migration serves the interests of all governments, and IOM can offer a broad range of programmers to counter trafficking and smuggling in human beings, from prevention to assisting the victims. IOM also implements programmers to facilitate the voluntary return and reintegration of displaced and stranded persons and other migrants, taking into account the needs and concerns of local communities.orced Migration Refugees and displaced persons are a distinct category of “people on the move” deserving special attention. IOM is active in assisting refugee populations during and after emergencies, as was the case in Kosovo and Timor. IOM also facilitates the resettlement each year of thousands of refugees for whom resettlement in a new country is the approved durable solution.

IOM is regularly asked to help find solutions for internally displaced persons (IDPs), former combatants, victims of ethnic engineering and populations in transition or recovery environments.

It also locates and assists widely scattered voters to enable them to take part in elections and referenda. IOM has large programmes and acknowledged expertise in post-war claims and compensation.olicy Activities Research and analysis are key to understanding migration, developing effective new policies and designing sustainable practical approaches. Providing public information on migration trends, challenges and opportunities is a key function of the Organization. IOM’s research and publications promote better understanding of migration issues. The biennial World Migration Report provides an overview of major migration trends and policy issues around the globe. The 2005 report focuses on the costs and benefits of international migration, and is available on line at www.iom.int.

IOM is strengthening its role in the field of international migration law, with special emphasis on the compilation, dissemination, understanding and implementation thereof. More broadly, the Organization carries out extensive training and capacity building programmes with governments and other partners as part of comprehensive migration management frameworks. In all these activities, the consideration of migrants’ rights and obligations, the gender dimension and the health implications of migration is central. Regular consultations among governments facing common migration challenges have become particularly important. With IOM’s substantive andlogistic support regional consultation processes exist in the Americas, Europe, Africa and the Asia- Pacific region. These mechanisms strengthen international cooperation, promote the sharing of information and experiences, and build confidence and partnerships on issues of common concern.

At the global level, the IOM Council’s International Dialogue on Migration is the principal international forum for intergovernmental migration policy debate, fostering enhanced understanding and cooperation on migration.

سازمان بين المللي مهاجرت در سال 1951 به عنوان سازماني اصولاً بين دولتي در حوزه مهاجرت تاسيس گرديد. اين سازمان سريعاً رشد يافت و در حال حاضر داراي 125 عضو مي باشد. 16 كشور داراي مقام ناظر در سازمان مي باشند همچنين سازمان هاي بين المللي و غير دولتي  متعددي داراي چنين وضعيتي هستند. بودجه برنامه هاي سازمان بين المللي مهاجرت در سال 2007 بيش از 8/783 ميليون دلار، سرمايه گذاري اين سازمان در بيش از 1770 برنامه فعال و بيش از 5600 كارمند عضو سازمان در بيش از 420 حوزه ميدان در بيش از يكصد كشور مشغول فعاليت مي باشند.

سازمان بين المللي مهاجرت براي پيشبرد مهاجرت منظم براي سود همگاني اختصاص يافته است. اين هدف از طريق ارائه خدمات ومشاوره به دولتها و مهاجران تحقق مي يابد.

سازمان بين المللي مهاجرت به گونه اي عمل مي نمايد كه به مديريت منظم مهاجرت ياري گردد، مشاركتهاي بين المللي در موضوعات مرتبط با مهاجرت ترفيع يابد، در انجام تحقيق براي راهكارهاي عملي براي مسائل مهاجرت مساعدت شود و به مهاجران محتاج خواه پناهنده ، آوارگان يا ديگر افراد كمك هاي بشردوستانه ارائه گردد. اساسنامه سازمان بين المللي مهاجرت صريحاً ارتباط بين مهاجرت و توسعه اقتصادي، اجتماعي و فرهنگي و همچنين حق آزادي جابجايي افراد را مورد شناسايي قرار داده است.

سازمان بين المللي مهاجرت در چهار حوزه گسترده مديريت مهاجرت فعاليت مي نمايد: مهاجرت و توسعه، تسهيل مهاجرت، نظم بخشي به مهاجرت و مهاجرت هاي اجباري. پيشبرد حقوق بين الملل مهاجرت ، مباحث و راهنمايي هاي رويه اي، حفاظت از حقوق مهاجران، بهداشت مهاجرت و بعد جنسيت مهاجرت؛ فعاليتهاي منقطع سازمان را شامل مي گردد.

سازمان بين المللي مهاجرت به طور خيلي نزديك با شركاي دولتي، بين الدولتي و غيرالدولتي همكاري مي نمايد.

 مهاجرت و توسعه

ارتباط بين كشورهاي مبداء و جوامع خارج از اين كشورها كليد توسعه موفق مي باشد. هدف سازمان بين المللي توسعه در اين حوزه  استفاده از پتاسيلهاي توسعه مهاجرت براي شخص مهاجر و جامعه مي باشد. در اين بخش سازمان از طريق پيشبرد گفتگوهاي رويه اي بين المللي، تحقيقات رويه اي و برنامه هايي كه سبب افزايش توانايي هاي انساني و مديريتي عمل مي كند.

فعاليتهاي برنامه اي  شامل بهبود مديريت مالي، ايجاد سرمايه انساني از طريق برنامه هاي مهاجرت كاري، بازگشت و استقرار مجدد افراد متبحر، ايجاد استعداد براي دولت ها و تفويض اختيارات به زنان مهاجر.

تسهيل مهاجرت

جابجايي يكي از ويژگيهاي ضروري جهان معاصر  ميباشد.بازارهاي يكپارچه جهاني، پيدايش شبكه هاي بين المللي و رشد سريع تكنولوژي ارتباطات همه اين عوامل سبب افزايش جابجايي كارگران ماهر و بي مهارت، دانشجويان، كارآموزان، خانواده ها و توريستها شده است.

ساختار جمعيتي و اجتماعي در جهان صنعتي سبب ايجاد احتياج به كارگران و متخصصان ديگر كشور ها شده است. مهاجرت هاي گسترده براي كار بالقوه مشكلات تطبيق را با خود دارد ليكن اقتصادهايي كه تمايل دارند رقابتي باقي بمانند نمي توانند لزوم تغيير را ناديده انگارند. تسهيل مهاجرت براي كار مي تواند يك پيشنهاد برد- برد باشد.

سازمان بين المللي مهاجرت مشاوره هاي رويه اي و فني را در خصوص تنظيم كار مهاجران و ديگر جابجايي هاي مهاجرتي به دولت ها عرضه مي دارد و برنامه هايي را تدارك مي بيند تا به دولت ها و مهاجران در انتخاب يا استخدام، زبان و موقعيت فرهنگي، خدمات كنسولي، آموزش، پذيرش، يكپاچه سازي و بازگشت مساعدت رساند.

اين خدمات – متناسب با هر برنامه- در تمامي مراحل اين موضوعات عرضه مي گردد: اطلاعات و اجرا، مصاحبه و تصويب، و مراحل بعد از تصويب. سازمان بين المللي مهاجرت براي بيش از 5/1 ميليون نفر در سراسر جهان سنجش پزشكي مهاجرت به اجرا درآورده است و به مهاجران مساعدت هاي حمل و نقل و مسافرتي عرضه داشته است.

تنظيم مهاجرت

دولت ها و جوامع علاقه مندند بدانند چه كساني درپي حصول به مرزهاي آنها هستند. مقصود اين است كه تدابيري اتخاذ گردد كه مانع دستيابي كساني گردد كه مجاز به حصول به اين مرزهانمي باشند در حالي كه بايد براي حصول افراد مجاز تسهيلاتي فراهم آورد. براي اين مقصود سازمان بين المللي مهاجرت كمك هاي فني و آموزشي  را در خصوص مديريت مرزها براي مديران دولتي مهاجرت، سيستم رواديد، تنظيم ورود و اقامت و جمع آوري و استفاده از اطلاعات بيومتريك  عرضه مي دارد.

جايگزيني جريان هاي بي رويه با مهاجرت هاي منظم براي تمامي دولت ها سودمند مي باشد و  سازمان  بين المللي مهاجرت مي تواند برنامه هاي گسترده اي براي مقابله با حمل و نقل و قاچاق انسانها- از جمله جلوگيري از وقوع و ياري به قربانيان- ارائه نمايد. همچنين سازمان بين المللي مهاجرت جهت تسهيل بازگشت آزادانه و استقرار مجدد آوارگان و  افراد معطل مانده و ديگر مهاجران با لحاظ احتياجات و نگراني هاي جامعه محلي برنامه هايي را به اجرا در مي آورد.

مهاجرت اجباري

پناهندگان و تبعيدي ها دو دسته متمايز از "افراد در حال جابجايي" هستند كه شايسته توجه ويژه مي باشند. سازمان بين المللي مهاجرت در زمينه ياري رساني به پناهندگان در طي و پس از اتمام شرايط اضطراري – مثل شرايطي كه در كوزوو و تيمور شرقي بود- فعاليت مي نمايد. همچنين سازمان بين المللي مهاجرت هر ساله اسكان مجدد هزاران پناهنده - كه براي اين افراد اسكان در يك كشور جديد راه حل پايدار تصويب شده باشد – را تسهيل مي نمايد.

اغلب از سازمان بين المللي مهاجرت درخواست مي گردد كه براي افراد تبعيدي داخلي، مبارزان پيشين، قربانيان طرح تفكيك نژادي و جمعيت هاي در حال انتقال يا افراد واقع در سرزمين نهاي در حال بازسازي؛ جهت حصول به راه حل مساعدت نمايد. اين سازمان همچنين راي دهندگان پراكنده را مستقر مي كند و به طور گسترده به آنها مساعدت مي نمايد تا اين افراد قادر گردند در انتخابات و رفراندوم ها مشاركت نمايند. سازمان بين المللي مهاجرت داراي برنامه ها و متخصصين معتبر بسياري در زمينه دعاوي پس از جنگ و مساله جبران خسارت مي باشد.

فعاليت هاي رويه اي

تحقيق و بررسي كليد فهم مهاجرت، رويه هاي جديد موثر در حال توسعه و طرح روش هاي عملي مناسب مي باشد.

اراده اطلاعات عمومي در خصوص روند مهاجرت، چالش ها و فرصت ها يك نقش كليدي سازمان مي باشد. تحقيق و انتشارات سازمان بين المللي مهاجرت موجب افزايش فهم موضوعات مرتبط با مهاجرت مي گردد.

گزارش دوسالانه مهاجرت در جهان بيانگر يك مروركلي بر اكثر روندهاي مهاجرت و موضوعات رويه اي در جهان مي باشد. گزارش سال 2005 بر هزينه ها و مزاياي مهاجرت بين المللي تمركز يافته است و اين گزارش در اين سايت قابل دسترس مي باشد: www.iom.int

سازمان بين المللي مهاجرت نقش خود را در حوزه حقوق بين الملل -با تاكيد ويژه بر تلفيق، انتشار، تفهيم و اجراي اين حقوق – گسترش داده است. به طور گسترده اين سازمان آموزش هاي جامع و برنامه هاي ايجاد استعداد را براي دولت ها و ديگر شركا – به عنوان بخشي از شبكه هاي مديريت مهاجرت – به اجرا درمي آورد. در تمام اين فعاليت ها توجه به حقوق و تعهدات مهاجران، بعد جنسيتي و لزوم بهداشت مهاجرت اصل مي باشد.

بويژه مشاوره هاي منظم كشورها در برخورد با چالش هاي معمول مهاجرت داراي اهميت بسياري شده است.  با حمايت هاي اساسي و لجستيكي سازمان بين المللي مهاجرت فرآيندهاي مشورت هايمنطقه اي در منطقه امريكا، اروپا، آفريقا، آسيا و اقيانوسيه فراهم شده است. اين مكانيسم ها افزايش مشاركت هاي بين المللي، پيشبرد تشريك اطلاعات و تجربه ها و ايجاد اعتماد و مشاركت در موضوعات مرتبط با نگراني هاي معمول را سبب شده است. در سطح جهاني شوراي گفتگوي بين المللي مهاجرت سازمان بين المللي مهاجرت براي مباحث رويه بين الدولتي مهاجرت، پيشبرد تفهيم و مشاركت در خصوص مهاجرت مرجع بين المللي اصلي مي باشد.
